The information or data provided by the User/Client will be processed in accordance with the provisions of the Privacy Policy. By using this website, the User/Client is consenting to the processing of the information and data collected and ensures that they are true and accurate.

Object and scope of application
The use of the Útero website and sales made through it are regulated by the following terms and conditions.
By placing an online order for any product on the Útero website, the User/Client:

• Acknowledges that has read and agreed to these terms and conditions;
• States that he/she is at least eighteen (18) years old and/or over the age of majority in the jurisdiction of residence, and has legal capacity to contract and use own means of payment;
• Will not make fraudulent use of the site, contrary to the law or good practice;
• Agrees that any dispute regarding the Consumer will be governed by Portuguese Law, notwithstanding any contrary legal provision, European Community directive or international treaty.
• Not share any digital content downloaded from the Útero website.

Útero is the owner of the Útero website and its contents.
These include documentation, images, characters, design, music, software, codes and format scripts.
All components of the STIVALI website are protected by copyright.
The reproduction, modification, transmission, republication and/or redistribution to third parties for commercial purposes are strictly prohibited without its prior authorization.
Útero does not allow the use of the contents on the website or its brand for any purpose other than those mentioned above.
Útero regularly updates its website and declines any responsibility for technical and typographical errors that may arise.
Some works/creations might need special conditions to be shipped, in such cases the Client will be informed of these limitations.
The Útero website is protected according to international Internet standards, so that, if it is used properly, the User/Client is assured they will not find viruses. However, Útero refuses liability for any problem, damage, virus or risk that the user may encounter arising from the improper use of the website, as well as any possible incorrect use of the website.
Útero reserves the right to modify the terms and conditions in this legal information without giving prior notice.

Product availability and order confirmation/cancellation
Útero only processes an order made by a client once payment is confirmed. As such, Útero cannot guarantee the merchandise’s availability until the aforementioned process begins.
Útero only dispatches orders on business days. Thus, the estimated time until the delivery of the orders does not account for weekends or holidays. Any delay that occurs in the shipping of the merchandise relative to the estimated dates provided does not grant the right to indemnity.
Fulfilment of all orders placed on the website is subject to product availability.Útero tries to ensure that all items for sale on the website are in stock. However, Útero reserves the right to not accept any orders or cancel orders already confirmed for any products that are no longer in stock.
The Client may cancel the order totally or in part before it is dispatched by Útero. If cancellation is confirmed, the amount will be reimbursed using the same payment method. Refunds are only made to the account/card originally used to make the purchase. In the case of payment by ATM reference, the customer will be contacted to provide a valid account number.

Stock unavailability
In the event a product is unavailable and/or out of stock, Útero will immediately inform the User/Client of the partial or total cancellation of the order. The client is entitled to a refund of the corresponding amount paid.
After informing the user of this unavailability, the contract is considered automatically terminated with regard to the unavailable item and the user is guaranteed that they will not incur any charges arising from the cancellation of the order of the unavailable item. The amount shown on the user’s card statement will be annulled proportionally.
The contract will remain in effect in relation to the other items that may have been ordered, unless otherwise specified by the user.

Liability
Útero will only be liable for damages suffered by the Client in the event that such damages result from infringement attributable to Útero’s contractual obligations before the User/Client or in the event that liability results from the applicable legal rights.
If the User/Client suffers damages related to the Útero’s liability would be limited to: damages to the products, reasonable and verifiable costs incurred by the Client because of violation of the present Terms and Conditions of Purchase and Use by Útero.
Útero cannot be held responsible for damages suffered by a third party as a result of the use of any of our products. Útero cannot be held responsible for damages suffered by the Client as a result of improper use of our products.
A Útero is not responsible for damages resulting from inaccurate information on the website.
All products commercialized by Útero, conform to Portuguese Law.

Intellectual Property Rights
The Client acknowledges and consents that all copyright, trademark and other intellectual property rights over the materials or content provided as part of the website correspond at any time to Útero or to those who granted us licence of use. The Client may only use this material in the manner expressly authorized by us or by those who granted us the licence of use. This does not prevent you from using this web page to copy your order information or Contract data as needed.

Applicable Law
The present Terms and Conditions of Purchase and Use and all litigation arising from these general terms must be governed by Portuguese Law.
In the event of litigation regarding the interpretation or execution of the present Terms and Conditions of Purchase and Use, Útero. and the Client shall endeavour to reach an amicable settlement that is fair and adequate within a maximum of 60 (sixty) days from the reception of the communication addressed to this effect by any of the parties involved.

Modification of the Terms and Conditions of Purchase and Use of the Utero online store
Útero reserves the right to change the present Terms and Conditions at any time. The User/Client is subject to the principles and terms in force on the date of order unless the Law or competent Authority imposes any modifications to them.
